In the following terms & conditions “the photographer” shall mean Liliana Séca Santos trading as Liliana Séca Santos Photography. “You” shall be the client or those persons booking the session. 

 

It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of these terms shall be effective unless agreed by both parties in writing.

 

By booking with Liliana Séca Santos Photography you agree to the below terms and conditions.

 

Photographer(s)

The main photographer will be Liliana Séca Santos, and where she deems appropriate, an assistant photographer of her choice will be provided at no extra cost. They will be the only stills photographers and videographers allowed to attend your photography session. 

 

Booking & Fees

A non-refundable fee is due upon booking in order to secure and reserve your session date and current pricing, unless otherwise confirmed in writing by the photographer. This is not an extra payment, it is included in the price shown and will be deducted from your chosen package. Please refer to your session pricing to learn the cost of your booking fee. The remaining balance of your selected package must be paid on the day of your session.

 

If you are unable to attend your photo session, you will be able to reschedule (subject to availability) at no extra cost, provided a 48-hour written notice is given. Failing to do so could lead to losing your booking fee and a new fee could be required should you wish to book another session.

Payments

No digital files, photographs, print proofs, online preview gallery or additional services will be delivered until all outstanding payment is complete. Payment may be made via bank transfer, PayPal or cash.

 

Prices

All charges are made in Pounds Sterling (GBP £). All prices are correct at time of booking when paid in full and no extra costs will be charged unless additional services or products are added at a later date. Services and products not specified at the time of booking are supplied at the prices ruling at the time of receipt of the order. Pricing is subject to change without prior notice.

 

Travel

Travel costs within London zone 1 to 3 are included in all my pricing. Should you wish to have a portrait session outside the areas covered within the packages, a surcharge will incur with the cost being dependant on the location.

 

Coverage

Photographs taken during the course of your session will be at the discretion of the photographer. Liliana Séca Santos Photography shall be entitled to use her judgement regarding the style and flow of the session. This includes but is not limited to poses, props and number of images taken. Special requests are not binding instructions, although every effort is made to comply with the client's wishes. The photographer will do her best to honour the requested photographs but will not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangements due to changes in weather and the availability and willingness of subjects.

 

On location, in certain circumstances, the photographer’s movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case. Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.

 

You are not allowed to use cameras, mobile phone cameras and camcorders during any session, in studio or on location without express consent of the photographer.

 

Creative Licence

Liliana Séca Santos Photography shall be granted creative and artistic licence in relation to the choice of locations and poses used. The photographer’s judgement regarding these matters shall be deemed correct.

 

Images

The editing process is a large part of the finish photograph and reflects the artistic style of Liliana Séca Santos Photography. The photographer’s judgement regarding the style and artistic input in the production of images shall be deemed correct. Edited photographs are not the same as retouched photographs. Editing refers to image adjustments in cropping, exposure, sharpness, contrast, colour correction, among other things, whereas retouching denotes digital manipulation (skin retouching, removal of objects, blemishes, spots, etc.). Retouched images will be retouched as specified. However, an edited image may have also been slightly air brushed, if necessary, at the discretion of the photographer.

 

All image sizes are nominal. All digital files have the aspect ratio of 2:3 which is ideal for most popular enlargement options. However, for some enlargements sizes, image cropping may occur. The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record the exact colour as seen by the human eye.

 

Display

You hereby allow the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, social media platforms, trade shows, etc. It is understood that in certain circumstances photographs cannot be used or reproduced. If this is the case, please confirm either by email or writing as per my contact details.

 

Third Party Printing

The photographer cannot accept any responsibility or liability for colour discrepancy or poor quality of any prints reproduced by third party printers such as high street photo processing shops or home printing.

 

Delivery

The number of images available for you for preview shall be deemed correct. The photographer will endeavour to provide you with a watermarked digital contact sheet or proofing gallery within a week after your photo session and deliver the final digital files between 2 to 4 weeks after you have selected your chosen images. During busy periods, delivery times will increase to between 6 to 8 weeks after preview. Digital images, files or photographs are provided in jpeg format only and delivered via email through download or on a USB collected in person.  Please ensure that you have stored your images safely and have multiple copies made when you download or receive your images on a USB stick. When a request is made to resend the files, if available, an admin fee of no less than £25 will incur to deliver the files again. All printed photographs, wall art and albums must also be collected in person. When products are requested to be posted, the client will handle all postage fees and ensure that the appropriate insurance is in place to cover any damage or loss during transit. All digital negatives (raw computer files) remain the property of the photographer and are not available for purchase by the client.

 

Copyright, Reproduction & Licensed Images

The copyright Designs and Patents Acts assign the copyright of all the images to the photographer.  No images can be copied, scanned or reproduced in any form whatsoever without the prior consent of Liliana Séca Santos Photography. You may not alter or add to or manipulate a picture by any means or reproduce a photograph in whole or in part as an element within, or as a montage with, another image without a written permission of the photographer. Permission to reproduce a picture for personal use (not commercial) is granted to you when digital files are purchased and paid in full to Liliana Séca Santos Photography. Any images provide to you by the photographer is licensed to you for sharing or displaying electronically with family and friends, and for printing by you only.

Upon receipt of the images, you accept all responsibility for archiving and protecting the photographs. Photographer does not permanently archive image files. Photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read USBs provided. 

 

Force Majeure (Act of God)

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure. In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid. Your statutory rights are not affected. Liliana Séca Santos Photography is insured with both Public Liability and Professional Indemnity Insurances. 

 

Cancellations, Lateness & No Shows

All cancellations must be communicated in writing to Liliana Séca Santos Photography. Cancellations can be made at any time, however, if you are unable to attend your photo session, you will be able to reschedule at no extra cost, provided a 48-hour written notice is given. Failing to do so will lead to losing your booking fee and a new fee will be required should you wish to book another session. When a written notice is issued, your session could be transferred to a new date which will be at the convenience of both parties within a maximum period of 6 weeks. The photographer reserves the right to postpone outside of this time limit due to any existing commitments. If the client fails to reschedule within the 6-week time period and no communication or attempt is made, Liliana Séca Santos Photography has the right to cancel the booking, retaining any money paid.

Liliana Séca Santos Photography reserve the right to cancel any booking if the client is running 15 minutes late and no prior notice is given. If client arrives more than 15 minutes late and decides to proceed with the session, the remaining time will be used as the session time and no extension will be granted. The photographer cannot be held responsible for not providing the requested variety of images when the booking was made, due to the lack of time caused by the late arrival of the client. No monies paid will be refunded and a new payment will be required in order to reschedule a new appointment. Similarly, when a client fails to attended the photo session or is a no show, the client will forfeit any monies paid.

However, it is understandable that life can be unpredictable and an emergency may occur. In this case, you will agree to make every possible effort to inform Liliana Séca Santos Photography no later than 12 hours prior to the start time of the photography session. It will be at the discretion of the photographer to arrange a further appointment with or without a new booking fee being requested.

In the event that the photographer needs to cancel your session due to bad weather, illness, or other reasons, your booking fee can be used towards rescheduling a new session or a refund can be issued. Refund will be made for the booking fee paid and any other payment completed.

 

Returns & Refunds

Due to the nature of custom-made portrait photography, no returns nor refunds will be accepted on any photography orders, unless the photographer deems that the photos are not sale worthy or if the digital images were lost or damaged before processing of the photos occurred. If any of those rare cases occurs then you will receive a full refund of all monies paid. If your order is received with damage an exchange will be made. Photographic proof of damage and order details needs to be emailed to Liliana Séca Santos Photography.

Complaints

Please address any complaints to Liliana Séca Santos Photography in writing by email as per my contact details. I will endeavour to respond to any complaint within 5 working days of receipt.

 

Conduct & Safety

The photographer will not tolerate verbally or physically abusive behaviour. If you and your guests are unable to control your conduct, resulting in an unacceptable degree of misconduct, or if the conduct of any of the guests damages the studio or the equipment of the photographer, it will result in the early or immediate departure of the photographer or of the offender. It is understood that in such circumstances no refunds will be granted on any money paid. 

 

Country of Jurisprudence

The parties irrevocably agree any dispute arising out of this contract shall be governed and construed in accordance with English Law and that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.
